Every submission on MarketScale includes built-in consent. At a minimum, users agree to our Terms of Service and Privacy Policy automatically when they continue to submit content. You can also customize your T&Cs if you send a Request in Studio
How It Works
Creating the Content
When someone receives a Request, the link takes them to a landing page showing what's being asked. Otherwise, this flow will trigger the first time the User creates content on MarketScale for your channel.
Seeing the Terms
Before they record, upload, or submit, they'll see this message:
"By continuing, you agree to MarketScale's Terms of Service and Privacy Policy."
Both are linked so anyone can review them instantly before continuing.
Giving Consent
Checking the box and submitting a response counts as consent. No hidden checkboxes, no surprise fine print. Just clear, built-in transparency.
What's New: Custom Terms for Requests
If you're using Requests, you can now add your own Terms and Conditions.
Here's how it works:
When creating or editing a request, add Custom Terms and Conditions to the text field.
When respondents open the request, they'll see your custom terms as well as the standard MarketScale ones.
The user must agree to those before submitting.
This means you can collect content under your own legal framework without needing a developer or lawyer on call. Fast, flexible, and fully self-serve.

What if I skip reading the Terms?
Submitting still counts as consent, but the links are always there if you want to read the full policies.
Do custom terms replace MarketScale's Terms?
No. MarketScale’s Terms remain visible as the default terms and are not replaced.
Custom terms are added alongside the existing MarketScale Terms, allowing your Organization to include additional requirements or legal language specific to your workflow or policies.
Can I see the full policies first?
Always. They're hyperlinked anywhere you're asked to consent.
